Politik uang dalam pemilihan umum maupun pemilihan kepala daerah terus
menjadi problematika menarik untuk dibahas namun memiliki daya
penyelesaian yang dapat dikatakan lemah. Sebagaimana diketahui bahwa
hukum akan berjalan baik ketika tiga faktor utama berjalan dengan baik pula,
yakni substansi hukum, struktur hukum dan kultur hukum. Jika melihat
berdasarkan substansi hukum, regulasi politik uang dalam undang-undang
pilkada telah mengakomodir kebutuhan hukum tersebut. Walau demikian ada
hal penting yang patut diperhatikan bersama yakni terkait unsur TSM yang
harus terpenuhi hingga dapat dikatakan sebagai pelanggaran politik uang.
Selain itu, budaya hukum sebagai salah satu unsur sistem hukum menjadi
perhatian khusus dalam penegakkan politik uang pada tulisan ini. Sebaik
apapun regulasi dan sebanyak apapun lembaga penegak hukum pemilihan
kepala daerah, jika tidak disertai dengan kultur hukum yang baik dari berbagai
pihak, maka penegakkan hukum tersebut hanya menjadi sia-sia.
